JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 4 – husband and his family members are before this Court in these petitions, calling in question orders of taking cognizance dated 30.07.2025, 10.06.2025 respectively, passed by the II Additional Senior Civil Judge and JMFC, Tumkuru, and the proceedings in - 6 - HC-KAR NC: 2026:KHC:29837 CRL.P No. 15166 of 2025 C/W CRL.P No. 14182 of 2025 CRL.P No. 270 of 2026 C.C.No.129/2025, for offences punishable under Sections 85, 115(2), 74, 54, 352, 351(2) r/w. 3(5) of the BNS and Sections 3 and 4 of the Dowry Prohibition Act, 1961, in all the three petitions. 2. Learned counsel for the petitioners – accused and respondent No.2 – complainant, in all the petitions, in unison would submit that the parties to the lis were before the concerned family Court in M.C.No.5970/2024 and during the pendency of these petitions, they have settled their matrimonial dispute amicably by drawing up certain terms and conditions. They have parted their ways and have filed a memo appending to it the entire order sheet of the concerned Court and the certified copy of the memorandum of settlement before this Court, seeking permission to compound the offences. 3. The memorandum of settlement reads as follows: “MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF THE CODE OF CIVIL PROCEDURE, 1908 READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. The parties above named beg to submit as follows:- - 7 - HC-KAR NC: 2026:KHC:29837 CRL.P No. 15166 of 2025 C/W CRL.P No. 14182 of 2025 CRL.P No. 270 of 2026 I. The aforesaid petition filed by the petitioner u/s 13 (1) (i-a), (iii) of the Hindu Marriage Act, seeking dissolution of marriage with the Respondent. II. The matter has been referred to mediation for resolving the dispute between the parties. In the course of mediation, the petitioner represented by his GPA holder Dr. Narayana Y D, and the respondent along with their counsels were present participated in the mediation proceedings, identified each other and the parties have resolved their dispute by agreeing to the following terms and conditions: 1. The parties are Hindus by religion and their marriage was solemnized on 02.06.2024 at Nithyotsava Kalyana Mantapa, Singanaykanahalli, Doddaballapura Road, Bengaluru-560064, as per Hindu rites and customs. 2. The petitioner and the respondent state that they have no children bom to them from their wedlock. 3. Due to difference of opinion and incompatibility, the petitioner and the respondent are living separate since 13.06.2024. The parties could not reconcile their differences and as such they have agreed to dissolve their marriage. 4. The petitioner has agreed to pay a sum of Rs.6,25,000/- (Rupees Six Lakhs Twenty Five Thousand Only) to the respondent towards maintenance/permanent alimony as full and final settlement of all her claims by way of demand draft bearing No.488131 dated: 16.05.2026 drawn on State Bank of India, Sahakarnagara Branch, Bengaluru and same shall be handed over to the respondent before the Hon'ble Court at the time of reporting settlement. 5. The petitioner and the respondent state that they have no claims of whatsoever nature against each other and also have no claims over the moveable/immoveable properties belonging to each other either for the past present or future. - 8 - HC-KAR NC: 2026:KHC:29837 CRL.P No. 15166 of 2025 C/W CRL.P No. 14182 of 2025 CRL.P No. 270 of 2026 6. Both the parties state that they have already exchanged their valuable articles. 7. Both the parties state that they withdraw all the allegations made against each other. 8. In view of the above settlement arrived between the parties the respondent has agreed to withdraw or take steps to close the complaint filed against the respondent in Crime No.192/2024 before Women's Police Station, Tumakur, which is now pending C.C.No.129/2025 before the II Addl. Senior Civil Judge and JMFC, Tumakur, against the petitioner and others which is now pending before Hon'ble High Court of Karnataka vide in Crl. Petition Nos.14182/2025, 15166/2025 and 270/2026 filed for quashing the proceedings in C.C.129/2025 and the respondent has agreed to co-operate to close the above case and the petitioner agreed for the same. 9. Both the parties state that out of their own free will and that there is no undue influence, coercion or fraud upon them for entering into the present agreement. 10.Both the parties have agreed to delete the photos /audio/videos/recordings of each other which are in their possession and indemnify other's privacy. Both parties have herein, undertake that they shall restrain themselves from making any statements/ allegations against each other in any public/social forum/platform. Both the parties have also agreed not to use any messages or photos against each other and spread outside to cause harm to the reputation of them. 11. Both the parties admit that they shall not interfere in the lives of each other in future. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized between them on 02.06.2024 at Nithyotsava Kalyana Mantapa, Singanaykanahalli, Doddaballapura Road, Bengaluru-560064, by - 9 - HC-KAR NC: 2026:KHC:29837 CRL.P No. 15166 of 2025 C/W CRL.P No. 14182 of 2025 CRL.P No. 270 of 2026 granting a decree of divorce in terms of the aforesaid agreement. IV. Parties will appear on 01.06.2026 before the Hon'ble Court for passing orders in terms of the agreement.” In the light of the afore-quoted memorandum of settlement, I deem it appropriate to terminate the proceedings against the petitioners in all the petitions, as it is a matrimonial dispute and the allegations are not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petitions are disposed. (b) The orders of taking cognizance dated 30.07.2025, 10.06.2025 respectively, passed by the II Additional Senior Civil Judge and JMFC, Tumkuru, and the proceedings in C.C.No.129/2025, qua the petitioners, in all the three petitions, stand quashed.
