1. Learned counsel for the applicant submits that WPS No. 3819 of 2026 came to be dismissed for want of prosecution
3 vide order dated 30.06.2026. It is submitted that, due to a bona fide mistake, learned counsel for the petitioner was not aware that the matter had been listed on the said date and was taken up by this Court earlier than the other matters listed in List-II. At the time when the matter was called, he was engaged in arguments before another Bench of this Court and, therefore, could not appear when the case was taken up. It is submitted that the non-appearance of learned counsel was neither intentional nor deliberate. Accordingly, it is prayed that the order dated 30.06.2026 dismissing the writ petition for want of prosecution be recalled and WPS No. 3819 of 2026 be restored to its original number. 2. I have heard learned counsel for the applicant and perused the material available on record. 3.
Considering the explanation offered by learned counsel for the applicant, this Court is satisfied that sufficient cause has been shown for non-appearance on the date when the matter was called. In the interest of justice, the order dated 30.06.2026 dismissing WPS No. 3819 of 2026 for want of prosecution deserves to be recalled. 4
4. Accordingly, the MCC is allowed. The order dated 30.06.2026, whereby WPS No. 3819 of 2026 was dismissed for want of prosecution, is recalled. Consequently, WPS No. 3819 of 2026 is restored to its original number. Sd/-
