Case No.9 of 2026 and the case is pending in court of learned Additional Chief Judicial Magistrate, Garhwa. 2. Mr. A.K. Kashyap, the learned Senior counsel appearing for the petitioner submits that earlier the petitioner has moved before this Court in ABA No.4156 of 2026 and the said anticipatory bail was withdrawn with liberty to find out remedy as the process under section 84 BNSS, 2023 was issued. He next submits that thereafter the petitioner has filed quashing application and said process has already been quashed by this Court and thereafter the present anticipatory bail application has been filed. 3. The learned counsel for the informant submits that on 07.09.2026 further process under section 82/84 BNSS, 2023 has been issued against the petitioner and certified copy of the order 2 dated 7.9.2026 was produced and on perusal of the said order, it transpires that process has been issued and the order is taken on record. 4. In view of above, Mr. A.K. Kashyap, the learned Senior counsel for the petitioner seeks permission to withdraw the instant petition with liberty to find out further remedy. 5. The leaned counsels for the State and the informant have got no objection. 6. This petition is dismissed as withdrawn with aforesaid liberty. ( Sanjay Kumar Dwivedi, J.) 10.09.2026 SI/
