1. The petitioner have filed this writ petition seeking following reliefs.
“10.1 That, this Hon'ble Court may kindly be pleased to quash the order dated 03.11.2025 of P/4 whereby respondent no. 04 has appointed the private respondent
2 / 3 (respondent no. 05) as Incharge CEO of Janpad Panchayat Fingeshwar, District Gariyaband, C.G., while bypassing the petitioner who is indisputably senior that the said respondent and consequently direct respondent no. 04 to appoint the petitioner as the Incharge CEO of the said Janpad Panchayat; 10.2 Alternatively, the Court may kindly be pleased to direct the respondents concerned to decide the petitioner's representation of P/1 within a fixed time frame within the four corners of law in the interest of justice; 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”

Learned counsel for petitioner submits that the petitioner is working as a Vikas Vistar Adhikar at Janpad Panchayat. Petitioner is senior in the cadre, but, the respondent No. 5, junior to the petitioner has been given the charge of CEO in contravention of the instructions issued by the State Government in this regard. He contended that the senior employee in the cadre is to be posted as Incharge on the higher post. Petitioner has submitted his representation which is pending
consideration before respondent No. 3 and 4 and therefore direction be issued to the concerned authority to take decision on the said representation.

Learned counsel for the State has no objection to the limited prayer made by counsel for the petitioner.
4. On due consideration of the submissions made by learned counsel for the parties, at this stage, writ petition is disposed of with a direction to the respondent No. 3 and 4 to take decision on the representation submitted by the petitioner, in accordance with law, expeditiously,
3 / 3 preferably within a further period of two months from the date of receipt of copy of order passed by this Court.
5. Accordingly, this writ petition is disposed of with the aforesaid observation and direction.
