Heard. 2. By way of this petition, the petitioners seek the following reliefs : 10.1) This Hon'ble Court may kindly be pleased to issue appropriate writ and quash / set-aside the impugned memorandum/order dated 6/9/22 (Annexure P-9) in the interest of justice. 10.2) This Hon'ble Court may kindly be pleased to issue a writ, order or direction of mandamus directing the respondent authorities to not interfere with peaceful possession of the petitioners over the disputed land in question and for not issuing any order curtailing the petitioners right to property under Article 300-A of the Constitution of India including right to further alienate the disputed land. 10.3) This Hon'ble Court may kindly be pleased 3 to call for the entire records of the instant case and of land for kind perusal of this Hon'ble Court. 10.4) Any other relief which this Hon'ble Court deem fit and proper may also kindly be granted to the petitioners in the interest of justice. 3. Learned counsel for the petitioners submits that vide order dated 6.9.2022 (Annexure P/9), the Sub Divisional Officer (R), Bilaspur (CG), restrained the sale and purchase of the land situated at P.H. No.19/29, Khasra No.992/9 Area – 4 acres, Tehsil Bilaspur District Bilaspur. Learned counsel for the petitioners submits that the SDO(R) is not the competent authority to pass such an order. As such, the impugned order is liable to be quashed. 4. Per contra, learned counsel for the State submits that the land in question is classified as Bade Jhad Kha Jungle and therefore, the petitioners cannot possess the said land without due authority of law. He refers to the impugned order dated 6.9.2022 to show that some enquiry is also going on in respect of the said land. 5. Considering the aforesaid aspects of the matter and further taking into account the impugned order dated 6.9.2022, this Court finds that an enquiry is being conducted in respect of the disputed land under different Khasra numbers, including the land of the petitioners. However, neither learned counsel for the petitioners nor learned counsel for the State/respondent is in a position to state whether the said enquiry has been completed or not. Further, there is no document to show what order, if any, has been 4 passed pursuant to the said enquiry. 6. In light of the foregoing, the Petition is disposed of reserving liberty to the petitioners to file an appropriate petition afresh, in the event it is found during the enquiry that the subject land belonging to the petitioners is indeed Bade Jhad Ka Jungle.
