JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – accused Nos.1 to 3, husband and his family members are before this Court calling in question proceedings in C.C.No.50424/2025, pending before the XI Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru, for the offences punishable under Section 498A of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. - 3 - HC-KAR NC: 2026:KHC:30588 WP No. 18487 of 2025 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family court in M.C.No.890/2026 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center. They couple have parted their ways. They are before this Court seeking permission to compound the offences. The parties have filed a joint memo and the entire order sheet of the concerned Court and a certified copy of the memorandum of settlement under Section 89 of the CPC r/w. Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, before this Court to that effect. 3. The memorandum of settlement reads as follows: "I. The Petitioners have filed a joint petition under Section 13 (B) of the Hindu Marriage Act, 1955 for dissolution of their marriage by mutual consent. II. The Hon'ble Court has waived off the statutory period of six months vide its order dated 09.02.2026. III. The aforesaid petition was referred to mediation for resolving the dispute between the parties, the petitioners along with their counsels were present and have resolved their dispute on the following terms and conditions: 1. The petitioners state that they are Hindus by religion and their marriage was solemnized on 17.12.2023 at Vistara Resorts and Hotels, 132, Near Basaveshwara circle, - 4 - HC-KAR NC: 2026:KHC:30588 WP No. 18487 of 2025 Mylasandra Dinne, Vaddarapalya, Bettadasanapura, Bengaluru-560083 as per Hindu rites and Customs. Subsequently, their marriage was registered on 25.04.2024, Bengaluru, before Banaswadi, Bengaluru vide certificate No. BNS-HM00056-2024-25. 2. Due to irreconcilable differences and incompatibility of temperaments, the petitioners have been living separately from May 2024. There is absolutely no chance of reunion amongst them. Hence, the petitioners have decided to get the marriage between themselves dissolved by a decree of divorce mutually. 3. Both the petitioners state that they have no children born to them from this wedlock. 4. The 1st petitioner has agreed to pay a sum of Rs.25,00,000/- (Rupees Twenty Five Lakhs Only) to the 2nd petitioner towards all her claims of permanent alimony/maintenance as full and final Settlement by way of Demand Draft bearing No.507134, Dated: 09.02.2026, Drawn on ICICI Bank, Kasturi Nagar Bengaluru and same shall be handed over to the 2nd petitioner at the time of reporting settlement before the Hon'ble Court. The 2nd petitioner has agreed to receive the same. 5. The petitioners have agreed to exchange their valuable articles such as gold and silver ornaments before the Hon'ble Court at the time of reporting settlement. 6. Both the petitioners state that they have no claims over the movable or immovable properties either previous existing or to be acquired in future. 7. There are no other claims of whatsoever manner against each other either past, present or in future. 8. In view of the settlement arrived between the parties, the 1st petitioner has agreed to withdraw the M.C. No. 4045/2024, pending before this Principal Judge Family Court, Bengaluru filed against 2nd petitioner. 9. The 1st petitioner has also agreed to withdraw the PCR No.54386/2025, pending on the files of XI ACJM, Mayohall, Bengaluru against the 2nd petitioner, Vppala Varun, Smt. - 5 - HC-KAR NC: 2026:KHC:30588 WP No. 18487 of 2025 Mounica and Smt. Srivalli within 15 days from receiving of final orders in the above case. 10. The petitioner has agreed to withdraw Crl.Misc.196/2024, pending before Hon'ble MMTC-I, Bengaluru filed against the 1st petitioner, Smt. Kantha Kumari, Sri Veer Kumar within 15 days from passing of final orders in the above case. 11. The 2nd petitioner has agreed to co-operate to closing/quashing in the FIR0142/2024 now converted into C.C. No.50424/2025, filed under section 49RA IPC and section 3 and 4 of DP Act. pending on the file of Hon'ble XI ACMM, Mayohall, Bengaluru before the Hon'ble High Court of Karnataka, Bengaluru. 12. Both the petitioners further state that there has been no collusion or force, fraud or any undue influence in entering into this settlement / agreement in the aforesaid manner. 13. Both the petitioners admit that they shall not interfere in the lives of each other in future. Both parties undertake not to post / share any of their photos / videos / messages / mails etc., taken or shared between them during the subsistence of their marriage, in any social media or otherwise. IV. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 17.12.2023 at Vistara Resorts and Hotels, 132, Near Basaveshwara Circle, Mylasandra Dinne, Vaddarapalya, Bettadasanapura, Bengaluru-560083 as per Hindu rites and Customs and cancel their marriage certificate which was registered on 25.04.2024, before Banaswadi, Bengaluru vide certificate No. BNS- HM00056-2024-25 pass a decree and judgment in terms of the aforesaid agreement by way of mutual consent. The joint memo reads as follows: “JOINT MEMO The undersigned counsels for the Petitioner and the Respondent herein submit that, the parties have resolved their dispute and have agreed to the Following terms and conditions: 1. The Respondent has paid a sum of Rs.25,00,000/- (Rupees Twenty-Five Lakhs Only) towards the Petitioner as the full and the settlement amourt vide DD bearing No.507139 dated 09.02.2026 drawn on ICICI bank, Kasturi Nagar, Bangalore. 2. Both the parties state that they have no claims over the movable or immovable properties either existing or to be acquired in future. 3. Both the parties agree that they have no other claim of whatsoever manner against each other ether past, present, or future. 4. Both the parties admit that they shall not interfere in lives of each other in future. 5. Both the parties admit that they shall not file any cases against each other in future. 6. Both parties agree to withdraw all the pending cases filed by respective parties before the trial courts.” In the light of the fact that the parties have arrived at settlement by parting their ways on certain terms and since it is a marital dispute, I deem it appropriate to accept the joint memo and obliterate the proceedings, as the allegations are not against the State. - 7 - HC-KAR NC: 2026:KHC:30588 WP No. 18487 of 2025 4.
