Page No.# 2/2 The learned APP submits that the identity card reflecting the date of birth of the petitioner has been verified and confirms that the petitioner is a student of the said institution. It was already observed in the earlier order that, at the time of commission of the offence, the petitioner appeared to be a minor. Today, learned Amicus Curiae submits that, in the event the petitioner was a minor at the time of commission of the offence, the relevant provisions of law would govern the proceedings. Having considered the materials on record, this Court is of the opinion that the continued custody of the petitioner, who was allegedly a minor at the time of commission of the offence, is not necessary. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of the like amount, subject to the satisfaction of the concerned jurisdictional court. The court considering the bail bond shall be at liberty to impose such other conditions as may be necessary to ensure the presence of the petitioner during the course of further investigation/trial.
