Both the learned counsel for the petitioner and the learned High Court Government Pleader would submit that trial has commenced, and the matter is at the stage of evidence. 3. The learned counsel for the petitioner submits that there are no allegations against the petitioner. He was not named in the FIR. He is drawn as accused while filing the charge sheet. All the submissions are to be projected before the concerned court at the appropriate time. 4. In the light of the judgment of the Apex Court in the case of Minakshi Bala -Vs- Sudhir Kumar, reported in (1994) 4 SCC 142, the petition stands disposed of reserving liberty to the petitioner to urge all the contentions before the concerned court.
