The petitioners are apprehending their arrest in connection with Devipur P.S. Case No.79 of 2026, for offence registered under section 191(2), 126(2), 115(2), 109(1), 303(2) and 351(2) of BNS, 2023, pending in court of learned Judicial Magistrate First Class, Deoghar.

Learned counsel for petitioners submits that altercation took place by the petitioners’ side and they have requested the informant’s side to lower down the sound of music and there are general and omnibus allegations against the petitioners. He next submits that allegation of assault is there against Kailash Das and Lutan Das and they have already surrendered before the learned court and the they have been granted bail. He also submits that there are case and counter case between the parties and he

submits that even the informant side has murdered father of the petitioner no.1 after one month of the lodging of the present case and for that another case has been filed against the informant side.
4. Learned State counsel opposes prayer and submits that allegations are there.

Considering that there are case and counter case between the parties and main allegation is against Kailash Das and Lutan Das and they have been granted regular bail and it has been pointed out that after one month of said incidence, father of the petitioner no.1 has also been murdered and for that another case has been lodged against the informant side, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Deoghar, in connection with Devipur P.S. Case No.79 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
