The petitioners are apprehending their arrest in connection with Nawdiha Bazar P.S. Case No.61 of 2026 for the alleged offences registered under Sections 126(2), 115(2), 117(2), 109(1), 303(2), 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Judicial Magistrate, First Class, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioners submits that the petitioners and the informant are agnates and the altercation took place due to the land dispute. He also submits that the civil suit is pending relating to the said dispute. He next submits that both the sides have received injury. He also submits that there are allegations of assault on leg. Further, he submits that the petitioners are having no criminal antecedents as stated in paragraph no.13 of the petition. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that allegation of assault is there. In view of that, prayer for anticipatory bail may kindly be rejected. 5. From perusal of the order of the learned Sessions Judge, it transpires that there is case and counter case. The civil suit as stated is also pending relating to 2026:JHHC:27195 Page | 2 A.B.A. No.5101 of 2026 the said dispute. It has been pointed out that both the sides have received injuries. The injuries are said to be simple in nature. 6. In view of the above, I am inclined to provide anticipatory bail to the petitioners. 7. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, First Class, Palamau at Daltonganj in connection with Nawdiha Bazar P.S. Case No.61 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
