SANJEEV PRAKASH SHARMA Order 24/04/2026 1. The present application has been filed seeking enforcement of the decree passed by Mr. Qiao Yang. 2. Learned counsel for the respondent has pointed out that proceedings have been initiated under Section 7 of Insolvency and Bankruptcy Code, 2016 and order has been passed by the National Company Law Tribunal, Jaipur Bench, (for short ‘NCLT’) which reads as under: “19. In view of the foregoing findings, this Adjudicating Authority is satisfied that:- (i) a financial [2026:RJ-JP:17550] (2 of 2) [ARBAP-126/2022] debt exists; (ii) default has occurred; (iii) the application is not liable to be rejected at threshold on limitation in view of pleaded acknowledgements; and (iv) there is no legal bar shown for admission under Section 7(5) of the Code.” 3. Having noticed the aforesaid action taken by the NCLT in case of Canara Bank vs. M/s Prayag Polytech Private Limited, I do not find it fit to appoint Arbitrator in the present case. The application is dismissed. However, the applicant is free to take recourse of the provisions of law which are available to him. (SANJEEV PRAKASH SHARMA),ACTING CJ Simple Kumawat /23
