Heard Mr. S. Mow, learned counsel for the applicants along with Ms. L. Hage, learned Additional Public Prosecutor for the State. This is an application filed under Section 5 of the Limitation Act, 1963, praying for condonation of a delay of 67 (sixty-seven) days in filing the criminal appeal against the judgment and order, dated 03.09.2025, passed by the learned Sessions Judge in Sessions Case No. 13/2021, corresponding to W.P.S. Case No. 06/2021, under Section 376 IPC read with Section 6 of the POCSO Act.
Learned counsel for the applicant submits that the delay of 67 days has been explained in Paragraph-3 of the application, which was beyond the control of the applicant as he was sent to jail after his conviction and sentence and therefore, needed time to contact a counsel. Ms. L. Hage, learned Additional Public Prosecutor, in all fairness submits that she will not be filing any written objection, since this is a statutory appeal. We have considered the submissions made by both parties and also perused the explanation given in Paragraph-3 of the condonation of delay application and are satisfied with the explanation given. Accordingly, the delay of 67 days in filing the connected Criminal Appeal No. 2 of 2026 stands condoned.
