ORAL ORDER
The petitioners have challenged the preliminary notification bearing No.CI 58 SPQ 2024 dated 15.03.2024 issued by respondent No.1 and the final notification bearing No.CI 58 SPQ 2024 dated 02.12.2024 issued by respondent No.1 for the purpose of formation of an industrial area in

respect of the land bearing Sy.No.127/3 of Adigarakallahalli, Sarjapura hobli, Anekal Taluk, Bengaluru Urban District.

(i) The learned counsel for the petitioners submits that the petitioners are the owners of land in Sy.No.127/3 of Adigarakallahalli, Sarjapura Hobli, Anekal Taluk, Bengaluru Urban District, measuring 02 acres 31 guntas which was notified by the respondent No.1 under Sections 3(1), 1(3) and 28(1) and 28(4) of the Karnataka Industrial Area Development Act, 1966 (henceforth referred to as 'Act, 1966 for short). He contends that the validity of these notifications came up for consideration before a Co-ordinate bench of this Court in W.P. No.6708/2025 and connected petitions and the Co-ordinate bench in terms of an order dated 08.01.2026 allowed the petitions in part and quashed the notifications. (ii) He contended that the order passed by the Co- ordinate bench of this Court was challenged in W.A.No.657/2026 and the Division Bench of this Court in terms of the order dated 26.03.2026 remitted the case back to the Special Land Acquisition Officer to consider the objections of the petitioners therein. Therefore, a similar order is required to

be passed in this petition also and respondent No.3 should be
directed to reconsider the objections filed by the petitioners pursuant to the preliminary notification dated 15.03.2024 issued by respondent No.1 under Sections 3(1), 1(3) and 28(1) of the Act, 1966.

Learned counsel for the respondent Nos.2 and 3 does not dispute the above said position of law as well as the orders passed by this Court referred supra.
4. In that view of the matter, this writ petition is allowed in part. The final notification dated 02.12.2024 issued by respondent No.1 under Section 28(4) of the Act, 1966 is quashed and respondent No.3/SLAO is directed to reconsider the objections of the petitioners in accordance with law and pass appropriate orders within a period of three months from the date of receipt of a copy of this order.
