Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 09.07.2026 1) The petitioner has filed this petition seeking the following reliefs: NIRMALA RAO 2 “10.1 That, the Hon'ble Court may kindly be pleased to quash the order dated 22.11.2021 (Annexure P-1) passed by respondent no. 3, being illegal arbitrary and without any authority of respondent no. 3, in the interest of justice. 10.2 That, the Hon'ble Court may kindly be pleased to call for the entire relevant records from the respondents. 10.3 That, Any other order of orders or Direction or Relief though just and fit in the circumstances of the case may also kindly be granted.” 2) Learned counsel for the petitioner would submit that the services of the petitioner were attached to Government Middle School Chimarkela, Block Basna, District Mahasamund vide order dated 22.11.2021. He would submit that the attachment of services is not permissible according to circular dated 4.6.2001 and therefore, petitioner has not been relieved from the present place of posting. He would pray to allow this petition. 3) On the other hand, learned counsel appearing for the State would oppose the submissions made by counsel for the petitioner. He would submit that for better administration of work, the services of the petitioner were adjusted at another school and the impugned order is not an order of attachment but a temporary administrative adjustment. He would submit that the petition deserves to be dismissed. 4) I have heard learned counsel for the parties and perused the documents placed on record. 3 5) A perusal of Annexure-P/1 dated 22.11.2021 would show that the services of the petitioner were attached from the Government Middle School Sarkanda, Block Basna to the Government Middle School Chimarkela, Block Basna. A bare reading of the circular dated 4.6.2001 would make it clear that the attachment of services of a government servant is not permissible. 6) Accordingly, the present petition is allowed and the order passed by the District Education Officer/ respondent No.3 dated 22.11.2021 (Annexure-P/1) is hereby quashed.
