Heard. 2. By way of this petition, the petitioners seek the following reliefs : i To kindly direct the respondent no.3 Tahsildar Raipur to act in accordance with law and release the entire lands of the petitioner forthwith by suitably demarcating the land. ii. To kindly direct the respondent State Government to take suitable action including imposition of penalty on the respondent Raipur Development Authority and payment of compensation to the petitioner for causing violation of absolute rights of the petitioner. iii. To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case including awarding of the costs to the petitioner. 3. Learned counsel for the petitioners submits that though the documents annexed with the petition show that two three demarcations were previously conducted to redress the grievance of the petitioners, but the petitioners did not participate in any of 3 those proceedings. He submits that the petitioners were never served with any notice by the concerned authorities regarding the said demarcations. Further, in the present petition also, none of the respondents have filed any demarcation report. 4. Considering the facts and circumstances of the case as also considering the arguments advanced by learned counsel for the parties, this Court deems it appropriate to direct the concerned State Revenue authorities to demarcate the land of the petitioners. The demarcation shall be conducted in presence of the petitioners as well as representatives of the Raipur Development Authority (RDA) in accordance with Section 129 of the CG Land Revenue Code and the Rules appended thereto, after giving due opportunity of hearing to all concerned parties. After completion of the entire exercise, the revenue authorities shall submit the demarcation report to the competent authority and a copy of the same shall also be supplied to the concerned parties. If, upon demarcation of the land of the petitioners, it is found that the land of the petitioners cannot be returned, the RDA shall initiate further proceedings in accordance with the findings of the demarcation report in respect of grant of compensation/exchange of land in lieu of acquisition of land of the petitioners.
