Chirag Bhanu Singh, Judge (Oral) By way of the present revision petition, the petitioner has laid challenge to the order dated 18.11.2025, passed by the learned Special Judge, (Additional Sessions Judge) Sundernagar, District Mandi, H.P., (hereinafter referred to as the trial Court), whereby the application preferred under Section 94 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking direction to the Investigating Officer to obtain and preserve the CCTV footage from the Cameras installed inside and outside Tunnel No.5, Bhawana.
2 ( 2026:HHC:44324 )
2. After due deliberations, the learned trial Court had dismissed the application holding that since investigations are going on and the Investigating Officer was in the process of procuring the data in question, and as such, no order was required to be passed. Consequently, the application came to be dismissed and hence the present petition.
3. The State has filed reply and inter alia specifically averred that the footage relating to 23.10.2025 of the CCTV Cameras installed on the entry point of Tunnel No.5 as well as ITMS Bhawana has been procured and preserved by the police. The call details records (CDRs) as sought by the petitioner have also been procured by the Investigating Agency.
4. Seeing to the reply filed by the respondent/State, the application has been literally rendered infructuous. The investigations are stated to have been completed and the challan stands already filed.
5. Even otherwise, the records sought to be produced have already been handed over to the Investigating Agency and as such, recourse to Section 94 will not otherwise lie in the facts and circumstances of the present case.
3 ( 2026:HHC:44324 )
6. In the aforesaid circumstances, the revision petition thus has been rendered otiose and is disposed off accordingly, so also the pending miscellaneous application(s), if any.
