1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicants who have been arrested in connection with Crime No.263/2025 registered at Police Station Jashpur, District Jashpur (C.G.), for the offence punishable under GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.07.10 18:43:11 +0530

This Court on 22/06/2026 granted bail to the applicants Ranvir Singh & Jagdeep Singh and directed the Director General of Police to reconsider the matter afresh against the concerned official and also call an explanation from the Senior Superintendent of Police, Jashpur as to how such a issue was taken by him so lightly, which concerned a wrong information sent to this Court by ASI, Manoj Bhagat.
3. In compliance of the Court’s order dated 22/06/2026, the Director General of Police has filed his personal affidavit, which reads as under:-
“xxx xxx xxx 2.That, the subject case came up for hearing before the Hon'ble Court on 22.06.2026 and after hearing of this matter, the Hon'ble Court has been pleased to direct the Deponent to reconsider the matter afresh against the concerned official and also call and explanation from the Senior Superintendent of Police, Jashpur as to how such an issue was taken by him so lightly, which concerned a wrong information sent to this Court by ASI Manoj Bhagat. Therefore, in compliance whereof, the instant affidavit is being filed before this Hon'ble Court for its kind perusal and
consideration 3.That, in compliance of the Hon'ble Court's direction, the
3 Deponent most humbly and respectfully submits that, the office of the Deponent has issued a letter on 02.07.2026 to the Inspector General of Police, Surguja Range, Ambikapur to take a necessary disciplinary action in the matter after reviewing the action taken against the ASI Manoj Bhagat and further to seek explanation from the concerned SSP, Jashpur in this regard. Copy of the instruction letter dated 02.07.2026, is being annexed herewith as Annexure R/A for kind perusal. 4. That, the Deponent most humbly and respectfully submits that, thereafter, the office of the Inspector General of Police, Surguja Range, Ambikapur has issued a letter on 02.07.2026 to the concerned Senior Superintendent of Police, District Jashpur whereby seeking explanation from him in the matter. Copy of the letter dated 02.07.2026 seeking explanation from the concerned SSP, Jashpur, is being annexed herewith as Annexure R/B for kind perusal of this Hon'ble Court. 5. That, the Deponent most humbly and respectfully submits that, thereafter, the office of the SSP, Jashpur has submitted his explanation in the matter on 04.07.2026 before the office of the Inspector General of Police, Surguja Range, Ambikapur. Copy of the explanation letter dated 04.07.2026, submitted by the SSP, Jashpur, is being annexed herewith as Annexure R/C for kind perusal of this
4 Hon'ble Court. 6. That, the Deponent most humbly and respectfully submits that, after considering all the aspects of the matter and the materials available on record, the concerned Inspector General of Police, Surguja Range, Ambikapur has passed a revised order on 05.07.2026 by virtue of which, the order dated 21.06.2026, passed by the SSP, Jashpur imposing fine of Rs. 500/- to the said ASI Manoj Bhagat, has been cancelled and instructions have been issued to the concerned SSP Jashpur and a departmental enquiry is proposed to be contemplated against the said ASI Manoj Bhagat. Copy of the review order dated 05.07.2026, issued by the IGP, Surguja Range, Ambikapur, is being annexed herewith as Annexure R/D for kind perusal of this Hon'ble Court. 7. That, the Deponent herein is duty bound to adhere and comply with the direction issued by this Hon'ble Court from time to time and it shall be his most sincere endeavour to ensure implement action with the coordination of the Police Officials as early as possible. 8.
That, the contents of the attached Affidavit at Paragraphs No. 01 to 07, have been drafted under my instruction and the contents thereof are true and correct on the basis of the records, available in the office.”

4. From perusal of the affidavit filed by the Director General of Police, it goes to show that departmental enquiry has been initiated against the Investigating Officer. 5. The outcome of the departmental enquiry initiated against the erring official shall be communicated by the Director General of Police to the Registrar General of this Court at the earliest, who shall place the same, as soon as the same is received by him for perusal of this Court in Chambers. 6. Learned State counsel is directed to communicate this order to the Director General of Police, for necessary information and compliance. 7. In view of the above, matter is consigned to record and bail application stands disposed of. Sd/-
