Petitioner/s Versus The State of Bihar ... ... Opposite Party/s ====================================================== Appearance : For the Petitioner/s : Mr. Paras Nath, Advocate For the State : Mr. Anil Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 2 09-07-2026 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.
2. The petitioner seeks regular bail in connection with Sherghati (Dhobhi) P.S. Case No. 685 of 2021 registered for the offence under Section 392 of the Indian Penal Code.
3. As per the prosecution case, unknown criminals are said to have committed loot of mobile phones, cash and other articles. The name of the petitioner has surfaced in self- inculpatory statement of the co-accused.
4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The petitioner is in custody since 17.11.2025.
5. Learned APP appearing for the State opposes the
Patna High Court CR. MISC. No.45671 of 2026(2) dt.09-07-2026 2/2 prayer for bail of the petitioner.
6. From the perusal of the records, it appears that though the present case was registered in the year 2021, he was arrested on 05.04.2022 in connection with Hunterganj P.S. Case No. 52 of 2022 and was subsequently remanded in connection with the present case on 17.11.2025. Considering the fact that the allegation against the petitioner is of looting mobile phones and cash and also the fact that the petitioner is involved in ten other criminal cases, I am not inclined to grant bail to the petitioner.
7. Accordingly, this application stands dismissed.
8. If the trial is delayed, the petitioner may renew his prayer for regular bail.
9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
