Accused No.3 in Crime No.5/2026 registered by Ijoor Police Station, Bengaluru South District, Bengaluru, for the offences punishable under Sections 8(c) and 22(b) of the NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.5/2026 was registered by Ijoor Police Station, Bengaluru South District, Bengaluru, for the aforesaid offences against one Saqil Pasha and others based on the first information dated 06.02.2026 received from George Prakash, police officer attached to Ijoor Police Station, Benglauru. During the course of investigation of the said case, petitioner herein was arrested on 12.02.2026 and subsequently, remanded to judicial custody. His bail application filed before the Trial Court in Crl.Misc.No.128/2026 was rejected on 23.03.2026. Therefore, he is before this Court. - 3 - HC-KAR NC: 2026:KHC:33060 CRL.P No. 7332 of 2026 4. Perusal of the first information in the present case would reveal that based on credible information received on 06.02.2026 at about 06.30 p.m., the first informant and other staff of Ijoor Police Station had apprehended accused No.1 - Saqil Pasha and from his possession, contraband article allegedly methamphetamine totally weighing 15.41 grams was recovered and seized under a panchanama. It appears that during the course of interrogation, he had informed that the said contraband article was supplied to him by one John and it is under these circumstances, FIR was registered in Crime No.5/2026 in which Saqil Pasha was arraigned as accused No.1 and John was arraigned as accused No.2. 5. Undisputedly, petitioner's name is not found in the FIR. It appears that during the course of further statement of accused No.1, he had stated that even petitioner had supplied contraband articles to him earlier. It is under these circumstances, petitioner was arrested on 12.02.2026 and remanded to judicial custody. It is not in dispute that as on this date, except the confession statement of accused No.1, there is no material collected by the prosecution to connect the - 4 - HC-KAR NC: 2026:KHC:33060 CRL.P No. 7332 of 2026 petitioner to the present crime. It is also not in dispute that petitioner has no other similar criminal antecedents. 6. The Hon'ble Supreme Court in the case of Tofan Singh vs. State of Tamilnadu - (2021) 4 SCC 1, has observed that confession statement of co-accused recorded under Section 67 of the NDPS Act, 1985, is not an admissible evidence. 7. Major portion of the investigation is now completed. Even otherwise, the seized contraband article from the possession of accused No.1 is only of intermediate quantity. Under the circumstances, I am of the view that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 8. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.5/2026 registered by Ijoor Police Station, Bengaluru South District, Bengaluru, for the offences punishable under Sections 8(c) and 22(b) of the NDPS Act, 1985, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:33060 CRL.P No. 7332 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
