02/ 11.09.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Nagar Untari P.S. Case No. 74 of 2026, registered under sections 96 and 137(2) of BNS, 2023 pending in the Court of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He next submits that the marriage of the daughter of the informant was solemnized forcefully by the informant with another boy namely Raju Choudhary due to that reason the daughter of the informant left the house without informing anybody. He next submits that the victim girl has returned to the parents house and the parents desired to send the girl again to her matrimonial house thereafter she has left the house and now she is residing in her parents house. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of taking away the girl.

By last order case diary has been called for which has been

received. In para 22 of the case diary the statement of the victim has been recorded under section 180 of BNSS and in para 24 of the case diary statement of the victim has been recorded under section 183 of the BNSS. Annexure-2 is the document which is statement of the victim before the Child Welfare Officer where she has stated that her marriage was solemnized with another boy for that she has left the house and now she is residing in the parents house.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa, in connection with Nagar Untari P.S. Case No. 74 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
