Accused Nos.1 and 2 in Crime No.50/2026 registered by Medigeshi Police Station, Tumakuru, for the offences punishable under Sections 109, 115(2), 329(4), 351(2), 352, 76 read with Section 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.50/2026 was registered by Medigeshi Police Station, Tumakuru, for the aforesaid offences against Lalithesh and others based on the first information dated 25.04.2026 received from Murthy S/o Ashwathappa. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.5161/2026 before the jurisdictional Sessions Court, which was dismissed as against them by order dated 07.05.2026. Perusal of the material on record would go to show that in respect of the alleged incident that had taken place at about 08.30 p.m. on 24.04.2026, a case and counter case in Crime No.50/2026 and 51/2026 were registered by Medigeshi Police Station, Tumakuru, on the next day of the incident. It is not in dispute that victims in both the cases have suffered only simple injuries. 5. Perusal of the first information in both the cases would reveal that parties have certain civil dispute between them with regard to pathway and in the background of the same, the alleged incident had taken place on 24.04.2026. Except the petitioners herein, all the other accused in the present case have been granted anticipatory bail. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.50/2026 - 4 - HC-KAR NC: 2026:KHC:33059 CRL.P No. 7396 of 2026 registered by Medigeshi Police Station, Tumakuru, for the offences punishable under Sections 109, 115(2), 329(4), 351(2), 352, 76 read with Section 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
