Accused no.1 in Crime No.114 of 2025 registered by Malleshwaram Police Station, Bengaluru City for offences punishable under Sections 406, 420, 120B, 504, 506 R/w Section 34 of IPC is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.114 of 2025 was registered by Malleshwaram Police Station, Bengaluru City for the aforesaid offences against petitioner herein and others, based on the first information dated 20.06.2025 received from Smt. Neeraj Shivanna, wife of Shivalingaiah. Apprehending arrest in the said case, petitioner has filed Crl.Misc.No.3424 of 2026 before the jurisdictional Sessions Court which was rejected on 16.04.2026. Therefore, she is before this Court. 4. Learned counsel for the petitioner submits that investment for the purpose of online trading in stocks was made by the first informant for the period from 2015 to 2019. - 3 - HC-KAR NC: 2026:KHC:33347 CRL.P No. 6735 of 2026 Complaint is lodged in the year 2025 by making false and baseless allegation against the petitioner, who is a lady having no other criminal antecedents. Petitioner is ready and willing to cooperate with the police for the purpose of investigation. Accordingly, she prays to allow the petition. 5. Per contra, learned HCGP has opposed the petition. He submitted that the petitioner has not been cooperating for the purpose of investigation and allegations found in the first information are serious. Accordingly, he prays to dismiss the petition. 6. In the typed first information dated 20.06.2025, it is stated that, first informant got acquainted to the petitioner in the month of March 2015 and she had introduced herself as a employee in the stock market. First informant allegedly had invested a total amount of ₹.1,58 crores for online trading in stock market for the period from 27.07.2025 to 30.5.2019. First information is filed on 20.06.2025 alleging that she has not received the assured returns nor the money invested by her. It is also further alleged that when a request was made to - 4 - HC-KAR NC: 2026:KHC:33347 CRL.P No. 6735 of 2026 the accused persons to refund the amount deposited, they have allegedly criminally intimidated the first informant. 7. It is not in dispute that petitioner has no other criminal antecedents. She is a married lady aged about 42 years. She has undertaken to cooperate with the police for the purpose of investigation. Alleged offences are triable by the Court of Magistrate and maximum punishment for the same is imprisonment for a period of seven years. Under the circumstances, the following:- ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.114 of 2025 registered by Malleshwaram Police Station, Bengaluru City for offences punishable under Sections 406, 420, 120B, 504, 506 R/w Section 34 of IPC, subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal - 5 - HC-KAR NC: 2026:KHC:33347 CRL.P No. 6735 of 2026 bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witness and she shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
