The petitioners are apprehending their arrest in connection with Ketar P.S. Case No.33 of 2026, for the alleged offences registered under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 324(4), 352 and 351(3) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Nagar Utari, Garhwa. 3. Learned counsel appearing for the petitioners submits that the petitioner No.1 is Mukhiyapati and has gone for mediation between the parties but the informant along with others have not complied with the same and falsely lodged the case against the petitioners and petitioner No.2 is labourer. She further submits that one Raghunandan Paswan has lodged the case against the informant and others alleging about the same occurrence. She then submits that there are general and omnibus 2026:JHHC:27503 --2-- A.B.A. No. 4660 of 2026 allegation against the petitioners. On these grounds, she submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that allegation of assault are there and petitioners are named in the FIR and in view of that anticipatory bail may kindly be rejected. 5. On perusal of the FIR, it transpires that there are general and omnibus allegation against all the accused persons and there are case and counter case and petitioner No.1 is said to be Mukhiyapati and petitioner No.2 is said to be labourer. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Nagar Utari, Garhwa in connection with Ketar P.S.
