Rakib (Rejected) CRM (NDPS) 903 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 1285 of 2023 dated 26.09.2023 under Sections 21(c)/27A/29 of the NDPS Act. Learned advocate appearing for the petitioner submits that the petitioner is a lady who has been detained in custody for two years nine months and so far as the recovery is concerned which is 520 grams of brown sugar. Further the chemical examiners test do not reflect the contraband was quantified. Learned advocate appearing for the State on the other hand opposes the prayer for bail and submits that 7 witnesses have already been examined and sometime be granted to complete the trial. I find that earlier the prayer for bail of the petitioner was rejected on the ground of merits of the case, particularly, with regard to the issue relating to Section 37 of the NDPS Act. The trial of the case has progressed substantially. 2 However, if the petitioner is in custody for two years nine months, I direct the learned trial Court to conclude the prosecution witnesses by 31st of December, 2026, in the alternative, the learned trial Court would leniently consider the prayer for bail of the present petitioner. Accordingly, CRM (NDPS) 903 of 2026 is dismissed at this stage. The learned trial Court would as directed above within the scheduled take the trial to its logical conclusion. The investigating officer of the case is present in Court, her further appearance before this Court be dispensed with. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
