This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 18/2025 registered at Police Station – Aamabeda, District – Uttar Bastar Kanker (C.G.) for the offence punishable under Sections 296, 351(3), 109, 121, 132, 190,191(2), 191(3), 221, 326 and 61 of the BNS and Sections 25 and 27 of the Arms Act. 2. The prosecution story, in brief, is that a dead body exhumation order of deceased Chamraram was issued by the SDM Kanker on 18.12.2025. Before that on 15.12.2025, after death of Chamrarm, large number of RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 tribal representatives and other individuals from village Badetewda and nearby villages were gathered there and were protesting against that body of deceased was not being buried according to their tribal rites & rituals but was not being buried according to rituals of the Christianity. During this, systematically incitement of the crowd was caused by giving inflammatory speeches. Unlawful assembly were formed for pursuing their common objective, armed with sticks, axes, bows & arrows reached the residence of Rajman Salam in village Chotewada and vandalized his house and set it on fire. Despite repeated warnings by police, they attached the police force with those sticks, axes, bows arrows and traditional arms and had obstructed the officials to perform their statutory duties. In the said incident, many police officials have suffered serious injuries on their body. Hence, this application. 3. It has been argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. It is further submitted that a total of two cases have been registered against the applicant on the basis of one incident, first is the present one and the second case is bearing Crime No.17/2025 registered at Police Station – Aamabeda, District – Uttar Bastar Kanker, and in the said case the co-accused persons have been granted anticipatory bail by this Court vide orders dated 07.05.2026, 20.04.2026 passed in MCRCA Nos. 693/2026 and 583/2026. Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant is not entitled for grant of anticipatory bail in this case. 3 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Having heard learned counsel for the parties and on perusal of the case diary as well as the material available on record, this Court finds that a total of two cases have been registered against the applicant on the basis of one incident, first is the present one and the second case is bearing Crime No.17/2025 registered at Police Station – Aamabeda, District – Uttar Bastar Kanker, and in the said case the co-accused persons have been granted anticipatory bail by this Court vide orders dated 07.05.2026, 20.04.2026 passed in MCRCA Nos. 693/2026 and 583/2026, at this stage without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Ramsingh Salam, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size 4 photo having printed the adhaar number on it, which shall be verified by the trial Court.
