The petitioner relies upon a set of photographs [Annexure-D], some of which read as under. - 4 - HC-KAR NC: 2026:KHC:28717 WP No. 13754 of 2026 The petitioner has not arrayed the owner of the opposite property as a party and this Court is of the view that there cannot be any order in this petition except an order directing the third respondent to consider whether the construction as seen in the photographs would be permissible after issuing notice to the aforesaid owner and file a report into this Court on the action taken if such construction is not permissible. The petition stands disposed of in the afore terms and also calling upon the third respondent to file a report with the Registry within eight [8] weeks from the date of receipt of a copy of this order on the action taken, and the petitioner is reserved with liberty to file a certified copy of this order with the third respondent within a week from the date of receipt thereof.
