This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.24/2024 registered at Police Station- Kerlapal, District- Sukuma (C.G.) for the offence punishable under Section 20(b)(II) MANPREET KAUR Digitally signed by MANPREET KAUR Date: 2026.07.10 11:12:17 +0530 2 (C) of the NDPS Act. 2. The prosecution case, in brief, is that on 09.10.2024, the Investigating Officer allegedly received credible information that a consignment of ganja was being illegally transported in a car bearing registration No. AP-05 AK-0567. Acting upon the said information and after allegedly complying with the mandatory provisions of the NDPS Act, the police party proceeded to intercept the vehicle. Upon search of the said car, the police allegedly recovered 40 packets containing 203.080 kilograms of ganja from the possession of accused Parkale Karan Parasram and 27 packets containing 54.755 kilograms of ganja from the possession of accused Sunil Ramjiyavan Prasad. On the basis of the said recovery, the present crime was registered against the accused persons for the commission of the aforesaid offences under the NDPS Act. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the police has not seized psychotropic substances from the exclusive possession of the applicant. The alleged contraband article has not been recovered from exclusive possession of the applicant. Further, the applicant is languishing in jail since 09.10.2024, though the charge-sheet has been filed, conclusion of the trial is likely to take some time hence, he prays for grant of bail. 3 4. On the other hand, the learned counsel for the State opposes the bail application and submits that from the possession of applicant and co-accused, total 203.080 kgs of ganja has been seized which is much above the commercial quantity, as the commercial quantity of ganja is 20 kgs, and further, bail of the co-accused namely Sunil Ramjiyavan Prasad has already been rejected by this Court in MCRC No. 5695/2026 vide order dated 29.06.2026 hence, the bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the nature and gravity of the offence and the fact that from the possession of applicant and co-accused, 203.080 kgs of ganja has been seized which is much above the commercial quantity, as the commercial quantity of ganja is 20 kgs and further, bail of the co-accused namely Sunil Ramjiyavan Prasad has already been rejected by this Court in MCRC No. 5695/2026 vide order dated 29.06.2026. In such a situation, it would not be justified to grant bail to the applicant/accused. 7. Accordingly, the bail application filed by the applicant/accused – Parkale Karan Parasram involved in Crime No.24/2024 registered at Police Station- Kerlapal, District- Sukuma (C.G.) for the offence punishable under Section 20(b)(II)(C) of the NDPS Act, is rejected at this stage. 8. Needless to say that the trial Court concerned, is at liberty to 4 proceed and conclude the trial expeditiously. 9.
