03/30.03.2026 Heard Mr. Sanjay Kr. Pandey-2, learned counsel for the petitioner, learned A.P.P and Mr. Rajiv Kr. Karan, learned counsel appearing for the informant.
The petitioner is an accused in connection with Bhandariya P.S. Case No.48 of 2025.
The petitioner on the pretext of marriage had continuously established physical relationship with the informant, as a result of which she had became pregnant. The petitioner had subsequently solemnized marriage with another girl.
Submission has been advanced by the learned counsel for the petitioner that the petitioner is in custody since 19.10.2025. It has further been submitted that the victim had attended the marriage ceremony of the petitioner as is evident from the testimony of P.W.1 and P.W.2 who are the parents of the victim.
Learned counsel for the informant has opposed the prayer for bail of the petitioner and has submitted that the victim has given birth to a girl child.
In view of the fact that the petitioner had, despite an assurance given for marriage, solemnized marriage elsewhere and the informant has given birth to a child, I am not inclined to grant bail to the petitioner. The same is hereby rejected.
