JUSTICE RAJESH MAZUMDAR ORDER 16.03.2026 Heard Mr. MD. A. Rahman, learned counsel for the petitioner. Also heard Mr. R.J. Baruah, learned Addl Public Prosecutor for the State. The learned Addl. Public Prosecutor has objected to the grant of bail, stating that based on the statement of the petitioners, a fourth person was arrested from whom an intermediate quantity of cough syrups was recovered and he has submitted that the FSL report is also awaited. The learned counsel for the petitioner submitted that the petitioners are addicts and that only one bottle of cough syrup and 3 strips of Hydrochloride and Acetaminophene capsules were recovered from the three accused persons. He further submitted that in connection with the same case, (Mukalmua P.S. Case No. 14/2026 under Sections 22(b)/27 of the ND&PS Act, 1985), one of the co-accused was granted bail by this Court on 10.03.2026 in Bail Appln. No. 664/2026. In view of the fact that only 13 strips of Hydrochloride and Page No.# 3/3 Acetaminophene capsules and one bottle of cough syrup were recovered from the three persons, the length of detention, and considering the submission that the petitioners are addicted, this Court deems it fit to grant the privilege of bail to the petitioners on furnishing bail bond of Rs. 20,000/- each, with two sureties each of the like amount, to the satisfaction of the Special Judge, Nalbari under the following conditions: 1) The petitioners will appear before the Investigating Officer as and when called for. 2) The petitioners will not influence the witnesses connected with the case.
