Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2 That this Hon’ble Court may kindly be pleased to direct the respondent authorities to make payment to the petitioner of his unpaid salary since 23.12.2013 to 16.07.2015 for 19 months with interest, within stipulated time, in the interest of justice. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to consider and decide the petitioner’s representations (Annexure P-3) submitted regarding payment of remaining salary since 23.12.2013 to 16.07.2015 for 19 months, within stipulated time, in the interest of justice. 10.4 That, any other relief which the Hon’ble Court may deemed fit and proper also be granted to the petitioner, in the interest of justice.” 2. Learned counsel for petitioner submits that petitioner was initially appointed as unskilled labour. The date of birth of petitioner was 23.12.1954, however, due to some error in record of respondents, they have mentioned the year as 1951 instead of 1954 and accordingly, petitioner was made to retire from service on 23.12.2013. Subsequently, respondents realizing their mistake have corrected the date of birth of petitioner as 23.12.1954 and, accordingly, in the PPO order, date of retirement of petitioner has been shown to be 31.12.2016. 3 / 3 3. He submits that in the aforementioned facts of the case, where the petitioner was not permitted to work due to mistake of respondent authorities, he is entitled for salary for the period from 23.12.2013 to 16.07.2015. Petitioner has submitted representation before Collector, however, it has not been decided. He also submits that petitioner may be permitted to submit fresh representation before respondent no. 4 and direction be issued to concerned authority to consider and take decision on representation to be submitted at the earliest, within specified time frame. 4. Learned counsel for State submits that in view of limited prayer made by learned counsel for petitioner , she is having no objection. 5. On due consideration of submission made by learned counsel for the respective parties and also considering the nature of grievances raised in this writ petition, I find it appropriate to dispose of this writ petition at this stage permitting petitioner to submit fresh comprehensive representation before respondent no. 4 and in the event petitioner submits such representation before the concerned authority it shall be considered and decided in accordance with law, expeditiously, preferably within a further period of 04 months from the date of receipt of representation. 6.
