This writ petition has been filed under Article 227 of the Constitution of India with the following prayers :- “(i) Issue an appropriate writ, order or direction commanding the learned District Judge, Dehradun, to decide Miscellaneous Civil Appeal No. 02 of 2024 filed by the Respondent/petitioner herein against the interim injunction order dated 06.12.2023 passed by the learned 7th Additional Civil Judge (Sr. Division). Dehradun, expeditiously and preferably within a time frame as deemed fit by this Hon'ble Court; (ii) Pass any other order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case; (iii) Award costs of the petition to the Petitioners.” 1 2026:UHC:1324 2. Learned 7TH Additional Civil Judge (Senior Division), Dehradun allowed the temporary injunction application of the plaintiff on 06.12.2023, filed in Original Suit No.488 of 2023, “Shri Vikas Bansal vs. Shri Govind Singh and Others”. The petitioner- defendant has filed the Miscellaneous Civil Appeal No.02 of 2024, which is pending. 3. Under the facts and circumstances of the case, the learned District Judge, Dehradun is directed to make an endeavor to decide the Miscellaneous Civil Appeal No.02 of 2024 expeditiously and without granting any unnecessary adjournment to either of the parties. 4. It is made clear that this Court has not expressed any opinion on the merit of the case. 5.
