NATARAJ ORAL ORDER The petitioner has challenged the preliminary notification bearing No.LAQ(1) CR 98/2006-07 dated 03.07.2009 issued by respondent No.1 in respect of 10 guntas of land out of 30 guntas in land bearing Sy.No.337 (old No.60/59) of Keragahalli, Jayapura Hobli, Mysuru Taluk. 2. The learned counsel for the petitioner submits that the question raised in this petition is no longer res integra in view of the order passed by this Court in W.P. No.24863/2025. 3. The learned counsel for the respondent No.1 does not dispute that similar questions of fact and law arose in W.P. No.24863/2025 and that the preliminary notification dated 03.07.2009 issued by respondent No.1 which is impugned in this petition was set aside therein. - 3 - HC-KAR NC: 2026:KHC:31431 WP No. 5209 of 2023 4. Consequently this writ petition is allowed. The impugned notification bearing No.LAQ(1) CR 98/2006-07 dated 03.07.2009 issued by respondent No.1 under Section 17(1) of the Karnataka Urban Development Authorities Act, 1987 in respect of land bearing Sy.No337 (old No.60/59) of Keragahalli, Jayapura Hobli, Mysuru Taluk measuring 10 guntas out of 30 guntas of land is quashed. 5. Any entry of the name of the respondent Nos.1 and 2 in the revenue records relating to aforesaid survey number stands deleted and the name of the petitioner shall stand restored.
