JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in Spl.S.C.No.22/2023, pending on the file of the Additional District and Sessions Judge and FTSC – 1 (POCSO), Chikkaballapura, for the offences under Sections 376(2)(n) of the IPC and Sections 5(l), 5(n), 5(j)(ii) and 6 of the Protection of Children from Sexual Offences Act, 2012. - 3 - HC-KAR NC: 2026:KHC:29843 CRL.P No. 46 of 2026 2. Heard Sri Devendra N., learned counsel for the petitioner, Smt. Waheeda M.M., learned High Court Government Pleader for respondent No.1 and Sri Srinatha B.V., learned counsel for respondent No.2. 3. Learned counsel for petitioner and respondent No.2 in unison would submit that the parties to the lis have settled the dispute and seek permission to compound the afore-quoted offences, on the score that the petitioner and the victim have married each other and also a child is born from their wedlock. They have filed separate affidavits of the parties before this Court to that effect. 4. The settlement between the parties cannot spring, in the case at hand, for the unique reason that the victim is 15 years and 6 months, at the relevant point in time. Therefore, there cannot be any closure of the proceedings on account of a settlement being drawn between the parties. 5. Therefore, the only order that could be passed is that, the concerned Court shall endeavour to conclude the proceedings in Spl.S.C.No.22/2023, with an outer limit of eight - 4 - HC-KAR NC: 2026:KHC:29843 CRL.P No. 46 of 2026 weeks onths from the date of receipt of a copy of the order, if not earlier. 6.
