Taking into account the matter in its entirety, this Court takes up the instant proceedings for disposal at the Motion stage. 3. The petitioner herein has assailed the order of removal dated 07.08.2025 and has further sought for certain consequential directions. 4. Be that as it may, it is very pertinent to take note of that pursuant to the order of removal dated 07.08.2025, the petitioner filed an appeal on 05.10.2025. It is stated in the memo of appeals filed before the Appellate Authority i.e. the Deputy Inspector General, CISF, that there was a delay of 28 days in preferring the said appeal. It is the further contention of the petitioner herein that the appeal filed on 05.10.2025 has not yet been considered or disposed of. 5. Taking into account that an appellate remedy is available under Rule 46 of the CISF Rules, 2001 and that the petitioner has already availed the said remedy, it is the opinion of this Court that the Appellate Authority should be directed to consider the said appeal on merits and dispose of the same, if it has not already been disposed of. 6. Accordingly, this Court, therefore disposes of the instant writ petition with a direction to the Deputy Inspector General, Page No.# 4/4 CISF, who is the Appellate Authority, to dispose of the appeal filed by the petitioner dated 05.10.2025, on merits without insisting on the question of limitation within a period of 60 (sixty) days from today. 7. It is further observed and directed that in the circumstance, the appeal has already been disposed of, a copy of the appellate order be furnished to the petitioner within a period of 30 (thirty) days from today. 8. Mr. S.P. Choudhury, the learned Standing Counsel appearing on behalf of the respondent Nos. 1 to 7 shall duly intimate the Appellate Authority about the present order as well as the directions issued herein. 9. This Court further observes that if the appellate order so passed against the petitioner, is not favourable to the petitioner, it shall not bar the petitioner to approach this Court, provided there is no other alternative and efficacious remedy.
