Accused Nos.2 and 3 in Crime No.162 of 2026 registered by Tumakuru Rural Police Station, Tumakuru for offences punishable under Sections 108, 86, 74 R/w Section 3(5) of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.162 of 2026 was registered by Tumakuru Rural Police Station, Tumakuru for the aforesaid offences against Hanumanthraju and the petitioners herein, based on the first information dated 07.06.2026 received from Smt.Mangalamma, mother of deceased Kalavathi. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.888 of 2026 before the jurisdictional Sessions Court which was rejected on 18.06.2026. Therefore, they are before this Court. - 3 - HC-KAR NC: 2026:KHC:33351 CRL.P No. 9251 of 2026 4. Perusal of the material on record would go to show that, petitioners herein are the brother and sister-in-law of accused no.1 - Hanumantharaju. Deceased Kalavathi was the wife of accused no.1. It appears that marriage of accused no.1 with the deceased was solemnized on 29.01.2020 and 30.01.2020. Allegation in the first information is that after the marriage accused persons were not properly looking after Kalavathi and she was being harassed and tortured in her matrimonial house. 5. From the averments found in the first information, it is very clear that for the last nearly about 2 years, deceased was staying in her parents' house and it appears that there was a dispute between the husband and wife with regard to custody of their child. On 07.06.2026, deceased had committed suicide in her parents' house when her parents and relatives had gone to see a girl for the purpose of performing the marriage of the brother of the deceased. In the first information, there is no mention of any such act committed by the petitioners herein immediately prior to the deceased committing suicide, which would have either abetted or instigated her to take the drastic - 4 - HC-KAR NC: 2026:KHC:33351 CRL.P No. 9251 of 2026 step of committing suicide. Petitioners who are husband and wife have undertaken to cooperate with the police for the purpose of investigation. 6. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.162 of 2026 registered by Tumakuru Rural Police Station, Tumakuru for offences punishable under Sections 108, 86, 74 R/w Section 3(5) of BNS, 2023 subject to the following conditions: 1. The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. - 5 - HC-KAR NC: 2026:KHC:33351 CRL.P No. 9251 of 2026 2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
