NATARAJ ORAL ORDER The petitioners have sought for a writ in the nature of mandamus to direct the respondents to consider their representations dated 02.05.2025 and 20.06.2025 and pay compensation in respect of the sites, formed in Sy. Nos.188 - 7 - HC-KAR NC: 2026:KHC:30742 WP No. 32202 of 2025 and 189 of Bikkanahalli, Sarjapura Hobli, Anekal Taluk, Bengaluru Rural district. 2. (i) The petitioners contend that they are the owners of sites formed in the aforesaid survey numbers. They contend that the respondent No.1 issued a notification proposing to acquire the aforesaid lands showing the name of Smt. R. K. Nagarathna as the Khathedar and Anubhavadar. The petitioner No.1 therefore filed a representation on behalf of all site owners on 02.05.2025 before the respondent No.4. Thereafter, a committee was constituted for determining the compensation payable and the said committee held its meeting on 02.05.2025, to which the petitioners were not invited. (ii) The petitioner No.1 therefore made another representation dated 20.06.2025. The petitioners claim that despite these representations, the respondents have not responded and they have not identified the petitioners as owners of the sites formed in the aforesaid survey numbers entitled to receive the compensation. They contend that respondent No.5 was the erstwhile owner of land in Sy. Nos.188 and 189 and she had executed a power of attorney in - 8 - HC-KAR NC: 2026:KHC:30742 WP No. 32202 of 2025 favour of Dwarakamai Enclave Sarjapur for developing the aforesaid lands for residential sites. Accordingly, the aforesaid lands were converted for non-agricultural residential use and after obtaining a layout plan from the concerned local planning authority, sites were formed and sold to various third parties. It is therefore contended that the petitioners being the present owners are entitled to receive the compensation and the respondents are bound to consider the request of the petitioners. 3. The learned counsel for the petitioners reiterated the aforesaid contentions and submitted that the petitioners being the present owners of the sites formed in the aforesaid survey numbers are entitled to receive the compensation and it is incumbent upon the respondent No.4 to consider the petitioners as persons interested to receive the compensation. He therefore prays that a direction be issued to the respondents to consider the representations of petitioner No.1 as stated above. 4. The learned counsel for the respondent Nos.2 and 4 submits that the representations of the petitioners would be - 9 - HC-KAR NC: 2026:KHC:30742 WP No. 32202 of 2025 considered in accordance with law and if the petitioners are entitled to compensation, the same would be looked into by the respondents. 5. In view of the aforesaid submission, this petition is disposed off, directing the respondent Nos.2 to 4 to consider the representations filed by the petitioner No.1 on 02.05.2025 and 20.06.2025 and consider payment of compensation to the petitioner Nos.2 to 20 in accordance with law. 6.
