This writ petition is filed challenging the order dated 07.09.2021 passed in O.S.No.26314/2017 by the LVII Additional City Civil and Sessions Judge, Mayohall Unit, Bengaluru (for short, ‘the trial Court’). 2. Heard Sri.Vasuki K.N., learned counsel for Sri.B.C.Prabhakar, learned counsel for the petitioner and Sri.V.S.Biju, learned counsel for the respondent. 3. The respondent-plaintiff has filed the suit in O.S.No.26314/2017 seeking the relief of declaration that the plaintiff is entitled to continue in employment with petitioner-defendant No.1 as the Category Manager - Two Wheel South and East or to such similar role without impacting his Grade and Pay Scale and other reliefs. In the said suit, petitioner-defendant No.1 filed detailed written statement denying the plaint averments. The plaintiff filed

an application under Ordre VI Rule 17 read with Section 151 of CPC seeking amendment of the plaint to incorporate certain facts as additional para 16(a) to 16(c) and additional prayers.
The aforesaid incorporation sought to be made in the pleadings are subsequent events as the suit is filed in the year 2017 and later the plaintiff was terminated vide later dated 28.02.2019 and the plaintiff also sought the substitution of prayer (b) from Rs.3,00,000/- to Rs.50,00,000/- as damages and sought additional prayer to reinstate the plaintiff to the earlier post which he was holding. The said application was opposed by defendant No.1. The trial Court under the impugned order allowed the application for amendment of the plaint. 4. It is required to be noticed that the plaintiff is seeking the relief of declaration that he is entitled to continue with the employment of defendant No.1 as Category Manager – Two wheel and other reliefs. In the said suit, the plaintiff is seeking to incorporate the later

events which have taken place after filing of the suit and also consequential relief and also to direct the defendant No.1 to reinstate the plaintiff to the said post. In my considered view, the later events which have taken place and also relief sought in the application would neither change the cause of action nor change the relief sought in the main suit. The trial Court, considering the said aspect, allowed the application which does not call for any interference. 5. It is always open for the petitioner-defendant No.1 to file additional written statement to the amended plaint and raise all the contentions which they have pleaded in the writ petition. 6. With the aforesaid observations, the writ petition is disposed of without interfering with the impugned order of the trial Court. Sd/- (VIJAYKUMAR A. PATIL) JUDGE
