09.07.2026. 1. Learned counsel for the State would submit that he is having case diary in his possession and ready to argue the matter finally. 2. Heard. 3. This is the third bail application of the applicant, who has been arrested on 04.11.2025 in connection with Crime No. 91/2025 registered at P.S. 2 Gambling (Prohibition) Act, 2022. The first bail application of the applicant has been rejected on merits 19.02.2026 passed in MCRC No. 110/ 2026. Thereafter, the second bail application of the applicant has also been dismissed vide order dated 02.04.2026 passed in MCRC No. 2970/2026, considering that there is no change in circumstances and the third bail application. 4. Learned counsel for the applicant would submit that the applicant is in jail since 04.11.2025 and there is no substantial progress in the trial of the case as the trial will again start with respect to co-accused Yogendra Sharma. He would also submit that the co-accused Yogendra Sharma has been granted anticipatory bail by the Hon’ble Supreme Court and therefore, there is change in circumstance to admit this third bail application of the applicant. He would also submit that the witnesses, who examined before the learned trial Court, have not duly supported the prosecutions case with respect to the present applicant and therefore, he may be enlarge on bail. 5. On the other hand, learned counsel for the State opposes the submission made by learned counsel for the applicant and submits that the first two bail applications of the applicant has been dismissed on merits. The allegation against the co-accused Yogendra Sharma is different than the present applicant.
He would further submit that the present applicant is also having previous criminal antecedent of four cases, out of which, one is still pending before the learned trial court. The trial is in progress and out of 11 witnesses, 8 witnesses has already been examined. Therefore, he is not entitled for bail. 3
6. I have heard learned counsel for the parties and perused the material annexed with the bail application. 7. Considering the submissions made by learned counsel for the parties, considering the nature of allegation against the present applicant as also his bail application has been rejected by this Court twice on 19.02.2026 in MCRC No. 110/2026 and 02.04.2026 in MCRC No. 2970/2026, also considering that the trial is in progress and out of 11 witnesses, 8 witnesses has already been examined, I am not inclined to release the present applicant on bail, as granting anticipatory bail to another co- accused is not sufficient to consider the change in circumstance in the case with respect to the present applicant. 8.
