The above writ petition was filed to declare the action of the respondents in not releasing the amount of Rs.5,12,117/-, payable to the petitioner in relation to the work i.e., Construction of Community Building in SC Colony, Uppumaguluru Gram Panchayat of Ballikurava Mandal, sanctioned vide proceedings RC.No.A/45/2021 dated 15.03.2021, as illegal and arbitrary. 3. Learned counsel for the petitioner would submit that the Mandal Parishad Development Officer, Ballikurava Mandal, passed a resolution vide Resolution No.849 dated 23.01.2024, for the construction of a Community Building in SC Colony in Uppumaguluru Gram Panchayat of Ballikurava Mandal and the petitioner was nominated to execute the work. Three works were entered into on 14.12.2023, and the petitioner completed the works. However, the amount has not been released so far. 4. Learned Standing counsel for the 5th respondent, submitted written instructions of the 5th respondent, wherein it was stated as follows: “It is humbly submitted that the petitioner has executed the work under “Mandal Praja Parishad General Funds” grant for construction of Community Building in SC Colony, Uppumaguluru Gram Panchayat of Ballikurava Mandal and I hereby submit that the amount of 4 Rs.5,12,117/- which was mentioned by the petitioner and same will be paid to the petitioner. Thus, as seen from the instructions of the 5th respondent, there is no dispute regarding the execution of work and the petitioner’s entitlement for Rs. 5,12,117/-, and the 5th respondent undertakes to pay the amount after due verification of the bills. Since the amount payable is admitted and undisputed, the writ petition is maintainable. In M/s Utkal Highways Engineers and Contractors v. Chief General Manager & Ors1, it was held at Para No.8 as under: “Be that as it may, the High court has not dealt with the merits of the writ petition. Moreover, it is not an inviolable rule that no money claim can be adjudicated upon in exercise of writ jurisdiction. Non-payment of admitted dues, inter alia, may be considered an arbitrary action on the part of respondents and for claiming the same, a writ petition may lie. Further, throwing a writ petition on ground of availability of alternative remedy after 10 years, particularly, when parties have exchanged their affidavits, is 1 2025 SCC online SC 1400 5 not the correct course unless there are disputed questions of fact which by their very nature cannot be adjudicated upon without recording formal evidence.” 6. Given the instructions furnished by the 5th respondent, the Writ Petition is disposed of directing the 5th respondent to release an amount of Rs. 5,12,117/- (Rupees Five Lakhs Twelve Thousand One Hundred and Seventeen only) payable to the petitioner regarding execution of the aforementioned work after due verification, within three (03) months from the date of receipt of the copy of this order.
