1. The petitioner expects this Court to interject in a matter arising out of proceedings invoked by the respondent No.1 joined by the respondents No.2 and 3 who are wife and minor children of the petitioner by reference to the Protection of Women From Domestic Violence Act, 2005 wherein the court of Judicial Magistrate 1st Class, Pampore has admitted the three respondents to monthly maintenance @ Rs.20 thousand per month by virtue of an order dated 12.02.2026 payable in favour of the respondents. Sr. No. 138 Supp. Cause List-I
2. On an earlier occasion, in terms of an ex-parte interim order dated 04.10.2024, the learned Judicial Magistrate 1st Class had admitted the three respondents to interim maintenance of Rs.9 thousand per month as an ad interim arrangement before the same came to be finalized by enhancing the monthly maintenance meant for three souls from Rs.9 Thousand to Rs.20 Thousands meaning thereby per respondent monthly maintenance has come to be Rs.6 Thousand plus amount which by no stretch of imagination came be said to be excessive or exorbitant for the petitioner not to bear the burden as being the husband and father of the two minor children with the respondent No.2 being a minor school going daughter.
3. The petitioner is seeking to stretch the respondent No.1 to this litigation in the High Court through the medium of this petition under article 227 of the Constitution of India.
4. This Court cannot put the respondent No.1 on notice without inviting the petitioner to first deposit an amount of Rs.25 Thousand as litigation expenses for the sake of
payment to the respondent No.1 to appear and contest the present writ petition.
5. At this stage, learned counsel for the petitioner submits that he would withdraw this petition which is, accordingly, dismissed as withdrawn.
6. A copy of this order be forwarded to the learned Judicial Magistrate 1st Class, Pampore for being taken on record on the file of the case.
