Accused in Crime No.118/2026 registered by Suddaguntepalya Police Station, Bengaluru, for the offences punishable under Sections 109(1) and 132 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.118/2026 was registered by Suddaguntepalya Police Station, Bengaluru, for the aforesaid offences against unknown car driver based on the first information dated 15.04.2026 received from Ajjappa Koth, police constable attached to Suddaguntepalya Police Station, Bengaluru. In the said case, petitioner was arrested on 02.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.4364/2026 was rejected on 19.05.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner submits that petitioner is a student, who is from Udupi. In the alleged incident that had - 3 - HC-KAR NC: 2026:KHC:33396 CRL.P No. 7514 of 2026 taken place on 15.04.2026, accidentally the victim has suffered injury. Petitioner has no other criminal antecedents. Major portion of the investigation is completed. He, accordingly, prays to allow the petition. 5. Per contra, learned Additional State Public Prosecutor, who has opposed the petition submits that as a result of the act committed by the petitioner, the victim, who is a police constable has suffered a fracture injury on his leg. Accordingly, she prays to dismiss the petition. 6. In the first information, which is submitted on 15.04.2026, it is stated that on the said day, at about 03.00 a.m. when the first informant and another police constable by name Lakshman were on duty, they found a white colour car moving suspiciously near Good Earth School. Therefore, first informant went towards the said car and all of a sudden, the driver of the said car pushed him and thereafter, drove away the car. The first informant allegedly followed him in a motorbike, but he could not trace him. The first informant has stated that, in the alleged incident, he has suffered a fracture - 4 - HC-KAR NC: 2026:KHC:33396 CRL.P No. 7514 of 2026 injury on his leg and his statement was recorded in the Hospital and FIR was registered against unknown person. 7. Petitioner aged 19 years, who is said to be a student, is in custody for the last more than one month. The allegation in the first information is that driver of the car pushed the first informant and thereafter, drove away the car. It is not the case of the prosecution that he had dashed his car as against the first informant. Petitioner has no other criminal antecedents. Major portion of the investigation is already completed. Learned Additional State Public Prosecutor has fairly submitted that petitioner is not connected to any other crime. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.118/2026 registered by Suddaguntepalya Police Station, Bengaluru, for the offences punishable under Sections 109(1) and 132 of BNS, 2023, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:33396 CRL.P No. 7514 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
