2026:HHC:42483 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CMPMO No.  : 73 of 2025 Decided on    : 30.09.2026 Kalapati alias Kalawati (deceased) through LRs …Petitioners Versus Vijay Kumar (deceased) through LRs & Ors. …Respondents The Hon’ble Mr. Justice Virender Singh, Judge. Whether approved for reporting?1 For the petitioners : Mr. Ashutosh   Bhardwaj, Advocate. For the respondents : Mr. Naresh   K.   Sharma, Advocate. Virender Singh, Judge (Oral) The petitioners being LRs of Smt. Kalapati alias Kalawati, are before this Court, under Article 227 of the Constitution of India, against the order dated 09.01.2025, passed   by   the   Court   of   learned   Senior   Civil   Judge, Ghumarwin, District Bilaspur, H.P. (hereinafter referred to as ‘the learned Executing Court’). 2. Vide   order  dated   09.01.2025,   passed   in   Civil Misc. Application No. 129 of 2025, in Execution Petition No.   492   of   2013,   titled   as   “Kalapati   Vs   Nand   Lal”,   the 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:42483 learned   Executing   Court,   has   dismissed   the   application under Order 6 Rule 17 of CPC. 3. For the sake of convenience, the parties to the present  lis,  are,   hereinafter   referred   to,   in   the   same manner,   as   were,   referred   to,   by   the   learned   Executing Court. 4. As per the record, it is not in dispute that the relief, which has been granted to the DH, in the Civil Suit, qua permanent prohibitory injunction, regarding the land bearing  Khasra No. 467/1/2, has now attained  finality. When, the said decree has not been honoured by the JDs, then during the pendency of the Execution Petition, the DH had moved the application under Order 6 Rule 17 CPC, with   a   prayer   to   permit   them   to   add   para   7(a),   in   the Execution   Petition. The   proposed   amendment,   is reproduced, as under: “7A That after filing the present application and after recording the evidence of the applicants the respondents have   occupied   whole   of   the   land   of   the   applicants measuring 004 biswa and are interfering continually on whole of the suit land and the respondents are liable to be detained in the civil prison till the interference and their   land   measuring   003   biswa   along   with   the construction of shops situated in Khasra No. 774/467, No. Khata Khatauni 127/143/139 m also be attached and sold in the public auction and a compensation of Rs. 2,00,000/ (Two lac) be given to the applicants.” 3 2026:HHC:42483 5. Admittedly, the proposed amendment is based upon the subsequent events, which had taken place qua the subject matter of the lis. 6. In such situation, the learned Executing Court has   fallen   into   error,   by   not   taking   on   record   the subsequent   events,   which   are   not   only   just   after   the execution of the decree passed against them, but the said amendment is also necessary for execution of the judgment and decree, which admittedly has attained finality, in the present case. 7. Hence, the order dated 09.01.2025, passed by learned Executing Court, does not sustain in the judicial scrutiny   by   this   Court   and   the   same   is   set   aside. Consequently, the application under Order 6 Rule 17 CPC, is allowed. 8. Any   of   the   observations,   made   hereinabove, shall not be taken, as an expression of opinion, on the merits of the case, as these observations are confined, only to the disposal of the present petition. 9. The   parties   to   the   lis   are   directed   to   appear before   the   learned   Executing   Court   on   14.10.2026,   at 10:00 am. 4 2026:HHC:42483 10. Pending application(s), if any, shall also stand(s) disposed of. 11. Record be sent back, forthwith. (Virender Singh) Judge 30th September, 2026 (Pramod Kumar)
