GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a writ, order or direction more particularly one in nature of Writ of Mandamus declaring the inaction on the part of the respondent No.3 in taking action against the respondent No.4 for the damage of petitioner crop in land in an extent of Ac.0.70 Cents in Sy.No.1917/3 each respectively and Ac.0.59 Cents in Sy.No.1917/4 each respectively of Chinnaorampadu Village fields, Obulavaripalli Mandal, Annamiah District and issuing an endorsement, dated 15-11-2025 to the effect that the issue is civil in nature and that the petitioner has obtained an order from Honble High Court with regard to the interference of the Police as illegal, arbitrary, apart from being fundamental rights guaranteed to the petitioner under Articles 14, 19, 21 of the Constitution of India and consequently set aside the same and direct the respondent No.3 to take action against the respondent No.4…” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Mr. P. V. N. Kiran Kumar, learned counsel for the Petitioner, submits that although the Petitioner submitted a complaint to Respondent No.3, the same was not registered as an FIR and no investigation was conducted. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that a PGRS complaint was received from the Petitioner, on which a preliminary enquiry was conducted. It was found that there exists a 3 civil dispute between the Petitioner and Respondent No.4, and therefore the police could not proceed further with the investigation. 5. Be that as it may, the Petitioner has got an alternative efficacious remedy by filing a private complaint before the learned jurisdictional Magistrate under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’. 6. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the Petitioner to approach the learned jurisdictional Magistrate by way of filing an appropriate complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’, if so advised. 7. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
