JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the registration of a crime in Crime No.49/2024 for the offences under Sections 406, 409, 417, 419, 420, 422, 423, 468 and 471 of the Indian Penal Code. 2. Heard Sri. Madhu E.K., learned counsel appearing for the petitioner, Smt. Rashmi Patel, learned HCGP appearing for respondent No.1, Sri. Manoj Madav N., learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:32756 CRL.P No. 3842 of 2026 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “JOINT AFFIDAVIT We, Roshan S/o Ibrahim, Aged 32 years, R/at No.36, KHB Colony, Housing Board, Hootagally, Mysuru District 570018 and Ravi Keerthi R. S/o.Ranganth, Aged about 39 years, R/at No.19/2, B.K. Nagara, 4th Cross, Yaswanthpura, Bangalore North District, Bangalore- 560022, do hereby solemnly affirm and state on oath as follows: 1. We state that we are the petitioner and 2nd respondent in the above case and we are well conversant with the facts and circumstances of the case. 2. We state that, the 2nd respondent had lodged a private complaint against petitioner and others in PCR No.19/2024 for the offences punishable U/s /s 406, 409, 417, 419, 420, 422, 423, 468 and 471 of IPC. Thereafter matter was referred u/s 156(3) of Crpc to jurisdictional police for further investigation then FIR was Registered in Cr.No.49/2024 of Vidyaranyapuram police pending on the file of I Addl. Civil Judge (Sr.Dn.) and CJM court at Mysuru City. 4. We state that the petitioner and the 2nd respondent state that due to intervention of elders, well- wishers and friends of both the parties i.e., petitioner and 2nd respondent have compromised above case out of the court. 5. We state that the Since the alleged offenses are non-compoundable in nature, we are filing annexed application, seeking leave of this Hon'ble Court to compound the said offences and to bring about a closure thereto by quashing the said proceedings. - 4 - HC-KAR NC: 2026:KHC:32756 CRL.P No. 3842 of 2026 WHEREFORE, we the petitioner and the 2nd respondent pray that this Hon'ble Court may be pleased to quash Proceeding in PCR No.19/2024 and FIR in Crime No.49/2024 of Vidyaranyapuram police for the offences punishable U/s 406, 409, 417, 419, 420, 422, 423, 468 and 471 of IPC pending on the file of I Addl. Civil Judge (Sr.Dn.) and CJM court at Mysuru City, in the interest of Justice. We the petitioners and the 2nd respondent undersigned declare that what stated in the above paras are true and correct to the best of our knowledge, belief and information.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit as quoted supra and offences not being against the State, I deem it appropriate to accept the joint affidavit and terminate the proceedings against the petitioner in the subject petition. 6.
