JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.53057/2026 registered for the offences under Sections 308(2), 49 read with Section 3(5) of the BNS, 2023. 2. Heard Sri. Lalith Kumar R., learned counsel appearing for the petitioners, Smt. Rashmi Patel, learned HCGP - 3 - HC-KAR NC: 2026:KHC:32758 CRL.P No. 9183 of 2026 appearing for respondent No.1, Sri. Athmananda Jambagi, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit in that regard, which reads as follows: “JOINT AFFIDAVIT OF THE PARTIES “1. Madhusudan S/o Venkataramanappa, Aged about 27 years Residing at No.220/1 Muneshwara Nilaya, 1st Cross Kammavari nagar, M V Extension Hoskote Bengaluru City Karnataka being the Petitioner No 1 & Sri. Ramesh Reddy S/o Venkatareddy, Aged about 36years Residing at No. 12, 3rd Cross, Near Ganesha Temple Ayyappanagar, K R Puram Bengaluru City Karnataka being the Petitioner No 2 & Sri. Anjanamurthy S/o Muniswami aged about 38 years Residing at No-10, 05th cross, 2nd Main, Opp Guru Sagar Hotel, Bengaluru City, Karnataka being the Petitioner No 3. SRI. NAGARAJU M N S/o. Nanjayya, Aged about 49 years, R/@ No 133, 1st Cross Kengeri, KR Pura Bengaluru city, Karnataka being the Respondent No. 2 do hereby solemnly affirm on oath and state as follows:- 1. We submit that, first us is the Petitioner No.1, second us is the Petitioner No.2. third us is the Petitioner No.3 & fourth of us are the Respondent no.2 respectively, in the above case and as such we know the facts and circumstances of the above case and hence, we are swearing this affidavit. 2. That the complainant/Respondent. No 2 had lodged a complaint against the accused/Petitioners, resulting in registration of FIR in Cr. No.862/2025 dated 21.11.2025, under Sections under Sections 308(2) of The Bharatiya Nyava Sanhita (BNS) 2023 at K R Puram Police Station, Bengaluru. Upon the investigation the respondent no. 1 filed a chargesheet in CC-53058/2026 - 4 - HC-KAR NC: 2026:KHC:32758 CRL.P No. 9183 of 2026 before the 29th ACJM MAYOHALL, BANGALORE for the offences under section 308(2), 49, 3(5) of BNS of 2023. 3. After due discussion and advice of well-wishers, myself and the Petitioners have come to conclusion not to proceed any further in the above said crime and hence I am not willing to continue the case against the Petitioners & I have no objection to quash the entire proceedings against the Petitioners. 4. That during the pendency of proceedings, both parties have resolved the dispute amicably and voluntarily, without any force, coercion, or undue influence. 5. I, the Second Respondent further state that I was unaware about the ordeal faced by the Petitioners and realized that pending of the proceedings would hamper his future and hence desired to withdraw our allegations made against the Petitioners and close the case on our own will and volition. 6. I, the Second Respondent further state that since I was wrongfully coerced by one Elle Srinivas to file the criminal complaint rather than directing me to me to intimating the right authorities, I am not willing to prosecute my complaint against the Petitioners and have no objection to quash the FIR in Cr No. 862/2025, registered by K R Puram Police Station, for the offences made penal under Sections 308(2), 49, 3(5) of BNS of 2023 of The Bharatiya Nyava Sanhita (BNS) 2023, now pending before XXIX ACJM, Mayohall, Bangalore. 7. We state that in view of the above, we have no grievances or claim against each other in future and we have filed this joint affidavit on our own volition without any coercion or threat, seeking to quash the case in CC. 53058/2026 before the 29th ACJM MAYOHALL, BANGALORE for the offences under section 308(2), 49, 3(5) of BNS of 2023, registered by K R Puram Police Station. 8. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of the joint affidavit as quoted supra being filed by parties to the lis and offences not being against the State, I deem it appropriate to accept the said joint affidavit and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
