This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 332/2025 registered at Police Station – City Kotwali, District – Raigarh (C.G.) for the offence punishable under Sections 318(3), 318(4), 316(5), 111 and 3(5) of the BNS. 2. The prosecution story, in brief, is that a written complaint was lodged by the complainant (Archana Pandey). She alleged that a woman named Lakshmi Patel introduced her to the main accused, Ramnarayan Sahu, in 2022, claiming he was an expert in share marketing. Relying on these assurances, the complainant and her family members allegedly invested approximately Rs.1,44,46,000. These funds were allegedly RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 channelled through investment schemes under the names of "Rana Jewellers" and "DMS Builders". The investment consisted of Rs.74,46,000/- transferred online to various bank accounts and Rs.70,00,000/- delivered in cash. When the complainant demanded the return of her money, the main accused provided a cheque that was subsequently dishonored due to "insufficient funds". Following the allegations of fraud and the realization of financial loss, an FIR was lodged at Police Station Kotwali, District Raigarh, and registered as Crime No. 332/2025 under Sections 318(4), 333, and 3(5) of the B.N.S.
2023. The present applicant, Rajkumar Sahu, was implicated based on the memorandum statement of the co-accused (Ramnarayan Sahu) and alleged bank entries showing transfers of the investment funds into his account. Hence, this application. 3. It has been argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. It is further submitted that there are two other criminal cases registered against the applicant of similar nature, in which the applicant has already been anticipatory granted bail by this Court vide orders dated 01.04.2026 and 23.03.2026 passed in MCRCA Nos.
452/2026 and 433/2026 on the ground of parity, and so far as the present case is concerned, the applicant has been implicated only on the basis of the conjectures and surmises reflecting from the memorandum statement of the co- accused. Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel as well as the counsel for the Objector opposed the bail application and submitted that the applicant
3 has two more criminal cases registered against him and he is a habitual offender, therefore, the applicant is not entitled for grant of anticipatory bail in this case. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicant, it transpires that there are two other criminal cases registered against the applicant of similar nature, in which the applicant has already been anticipatory granted bail by this Court vide orders dated 01.04.2026 and 23.03.2026 passed in MCRCA Nos. 452/2026 and 433/2026 on the ground of parity, and so far as the present case is concerned, the applicant has been implicated only on the basis of the conjectures and surmises reflecting from the memorandum statement of the co- accused, at this stage without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rajkumar Sahu, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.
4 (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant shall not involve themself in any offence of similar nature in future. Sd/-
