The present petition has been preferred for the Patna High Court CWJC No.10511 of 2026(2) dt.21-07-2026 2/4 grant of following relief(s): “(i) for direction/order to the respondent number 2, the District Magistrate, Bhojpur at Ara, respondent no. 5 the Sub-Divisional Officer, Bhojpur, respondent no. 6, the Circle Officer, Bihiya Bhojpur, respondent no.7 the officer-in- Charge, Bihiya, Bhojpur to constitute an enquiry expeditiously and respondent no. 10 to 14 may kindly be directed to stop the forceful, illegal encroachment on the raiyati land of the petitioner lawfully purchased from respondent IIIrd set Manoj Kumar Sharma @ Pappu Sharma in the year 1997 on 26.08.1997 vide Sale Deed No. 6944/1997 and coming in peaceful possession since 1997 after making pakka boundary and Karkat house with iron gate whereupon respondents IInd set are demolishing the structure of the petitioner and started pilling etc. on the plot of petitioner with area one Dhur and Five Dhurki only under Mauza-Bihiya, Thana No.-96, registry office Jagdishpur, District-Bhojpur with Khata No.-699, Khesra Patna High Court CWJC No.10511 of 2026(2) dt.21-07-2026 3/4 No.-1204, Area 01 Dhur 05 Dhurki with boundary North- Self and Shakti Sharma, South Indra Dev Shah, East-Neej, Man Mokir (self), West-Neej Rasta, length E-W = 15 feet, width N- S = 6 feet. (ii) for other relief/reliefs as your lordships may deem fit and proper in the interest of justice to the petitioner.” 3. The petitioner claims to be owner of piece of land details of which has been incorporated in prayer portion itself and needs no repetition. 4. The contention is that of late, respondent no. 10 to 14 are disturbing in peaceful physical possession. He also approached the Sub-Divisional Magistrate, Jagdishpur, Bhojpur which led to Case No.40 of 2026 (Kameshwar Sharma vs. Geeta Devi and Ors.) but no further step has been taken. 5. Learned State counsel submits that he has to approach the right court and the Sub-Divisional Magistrate, Jagdishpur, Bhojpur will be taking the matter to its logical conclusion in accordance with law. 6. Considering the submissions of the parties, the writ petition is disposed of directing the Sub-Divisional Magistrate, Patna High Court CWJC No.10511 of 2026(2) dt.21-07-2026 4/4 Jagdishpur, Bhojpur to immediately take up the aforesaid Case No.40 of 2026 pending before his/her office and see to it that final order is passed at an earliest and in any case, within a period of three months from the date the copy of the order is handed over to his/her office. vinayak/- (Rajiv Roy, J) U
