2. Mr. Tanuj Pattwardhan, learned counsel appearing for the petitioners would submit that in the year 2020, the petitioners were posted as Constables in naxalite area. He would contend that on 08.05.2020 after receiving an information, the petitioners along with members of joint team proceeded to Village Pardoni under Police Station Manpur and participated in the naxal operations. He would further contend that the naxals had information with regard to arrival of the police party and they started firing indiscriminately and in turn the members of joint team immediately retaliated. It is argued by Mr. Pattwardhan that though the petitioners actively participated in the naxal operations, but they have not been considered for promotion according to Regulation 70 of the Police Regulations.
He would submit that the petitioners have made representation before the respondent No. 3 on 14.05.2022, but till date said representation has not been decided. He would contend that a direction may be issued to the respondent No. 3 to decide pending representation expeditiously. 3. On the other hand, Mr. Anmol Sharma, learned Panel Lawyer appearing for the State/respondents would contend that the maximum limit to grant out of turn promotion in particular category is 10% of total promotion. He would argue that the many members of the force participated in the naxal operations and it is not possible for department to grant promotion to each and every participants exceeding limit of 10%. It is also contended that case of the petitioners has already been considered and they have been rewarded with cash
3 prize vide order dated 26.02.2022. He would submit that the petition being misconceived deserves to be dismissed. 4. I have heard learned counsel for the parties and perused the documents. 5. Having considered limited prayer made by Mr. Pattwardhan, this petition, at this juncture, is disposed of with a direction to the respondent No. 3 to decide pending representation of the petitioners dated 14.05.2022 expeditiously strictly in accordance with law preferably within a period of 150 days from the date of receipt of copy of this order. 6.
