1. The petitioner has filed the instant petition for following reliefs:-
“10.1 It is prayed that this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner for its kind perusal. 10.2 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, order, direction thereby directing the respondents to accept the payment of the remaining amount in compliance of the allotment/settlement order dated 28/02/2023, in easy small equal installments. 10.3 That this Hon’ble Court may kindly be pleased to issue an appropriate writ, order, direction thereby directing the respondents to handover the settlement/allotment order to the petitioner with respect to the subject property. 10.4 Any other relief/reliefs, which this Hon’ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also be granted to the petitioners.”

Learned counsel for the petitioner submits that on the basis of notification dated 26.10.2019, the petitioner who is an illegal occupant of a Najul land has made an application for allotment of the sale land on the basis of the State Government's regularization scheme in which he has been directed to pay a sum of Rs. 3,06,157/- for allotment of the land in which he is in
3 possession as an illegal occupant. The petitioner failed to deposit the said amount, as such the allotment order cannot be passed. He next submits that the petitioner has only paid a sum of Rs. 1 lakh and rest of the amount has not been paid within the time frame. He further submits that the present writ petition has been preferred seeking a direction to the respondent authorities to permit the petitioner to deposit the remaining amount of Rs. 2,06,157/- and to consider passing the final allotment order in terms of the order dated 28.02.2023, in accordance with law.

Learned State counsel submits that the notifications dated 11.09.2019 and 26.10.2019, under which the petitioner seeks allotment of the subject land, has already been withdrawn by the State Government vide circular dated 23.07.2024. Consequently, the relief sought by the petitioner cannot now be granted under the withdrawn policy. It is, however, fairly submitted that the petitioner had deposited a sum of Rs. 1,00,000/- pursuant to the
order passed by the concerned Collector, but such deposit, by itself, does not confer any vested right upon the petitioner to claim allotment under a policy which is no longer in force. 4. Heard learned counsel for the parties and perused the material available on record. 5. From the perusal of the record it appears that since the scheme itself was withdrawn vide order dated 23.07.2024, which is reproduced herein as under:-

It is evident that the petitioner has paid a sum of Rs. 1,00,000/- as installment and the petitioner was directed to deposit entire amount of Rs. 3,06,157/- along with premium amount, the petitioner could not deposit and during the pendency of the aforesaid situation, subsequent notifications were issued, as such the relief claimed by the petitioner for allotment of the land cannot be passed.
Since the allotment order was subject to conditions which has not been fulfilled, as such the petitioner could not be granted relief as prayed. However, since the petitioner deposited a sum of Rs 1,00,000/- before the concerned authority, as such the authorities concerned are directed to refund the same amount along with the interest of 6% per annum from the date of deposit till the date of actual payment. It is further observed that the petitioner shall be at liberty to avail such remedy as may be available to him under the law by filing appropriate application before the competent authority in accordance with law. 7.
