CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE. ORDER 19.08.2026 1. Absence of the counsel for the petitioner on this date of hearing is understandable in the backdrop of order dated 05.08.2026. 2. Accordingly, the two petitions- WP(C) No. 1630/2025 and CM(M) No. 303/2026 stands dismissed for deliberate non-prosecution on the part of the petitioner as well as her counsel. In fact, if the counsel for the petitioner would have been present, the dismissal of the writ petition on merits perhaps would have been with an exemplary costs. 3. Interim direction(s), if any, shall stand vacated. 4. However, this Court directs the Court of learned Munsiff, Budgam, to confront the counsel for the plaintiff/petitioner herein- Masrat Salam, about the maintainability of the civil suit 04 Regular at the first instance, by taking recourse to Order VII Rule 11 read with Order X of the Code of Civil Procedure, 1908. 5.
